i got a couple of payday loans because i desperately needed them and now they are trying to take money out of my bank account in which i have nothing in, my employer sends me my check to a bank account my boyfriend had to put me on so that they wouldn’t be able to touch my wages, i mean what can they do if you’re in the state of texas?

  1. they can go after you anyway legally possible. that’s what you get for using payday loans. maybe if you didn’t overspend and pay back your loans you wouldn’t be in this pickle.

  3. Yes,but they cannot take much.It’s surprizing what they can do nowadays,but if you dont make an arrangement ahead of time,yes,they can garnish some.

  4. When you took the payday loan, you probably missed a clause that allowed them to extract from your account. They can’t officially garnish you wages without a court judgment against you. However, in the event of a garnishment, they are only allowed to take so much…15% max I think. It tends to vary from state to state.

  7. In Texas, they cannot garnish your wages, but they can attach your bank account if they receive a judgment against you. Do not use direct deposit, instead cash your checks yourself and stash the cash in your sock drawer
    Texas law does not allow garnishment of wages for ay reason. Also, you may be “judgment proof” if you have very few assets. Texas has generous laws protecting debtors..

  8. Is it legal to garnish your wages to pay this loan back. You did sign paperworks stating that you will pay this loan; therefore, they have the right to get the money back. You should of known what the outcome was when you signed up.

    If the loan company seeks legal documents to the government to garnish your wages, the government will contact your employer. Then, your employer will deduct the amount according to court documents and whatever is remaining goes into your account.

    How can you be on Welfare and be working? Well I guess anything is possible I don’t think they can take your welfare unless you deposit it in a bank

  10. They can take you to court and sue you and you can rack up insane fees for this. The court system may garnish your wages straight from your employer. You can also face criminal charges for writing bad checks. It’s best to come clean and make realistic payment arrangements. Don’t dodge them, they know how to go about getting their money bad.

  11. You can be charged with theft, and fraud, have a court order, and an arrest warrant put out on you. If it was from out of state that makes it Federal. (Theft and or fraud crossing state lines) Interest, penalties and court costs will be added, and jail time possible. The state of Texas is still inclusive to the United States, so there is no protection there. If the total was over I believe $1000 then that is considered grand theft, and definite jail time of 5-10. You took the money under those terms just pay it back. Lucky is was not a loan shark

  12. They can get a garnishee order from the court and serve it on your employer. Do not hide from them, simply make payment arrangements.
